Buckhorn - Due Process

I recently returned from attending a portion of the Common Council meeting.

During the Citizen Comment Period, two Franklin citizens spoke.  Here is a summary of what they said:

Orville Seymer spoke first and told the Council he lives just around the corner from where the incident occurred and has family and friends who have been involved in accidents and death related to drunk drivers.  He said, "I am opposed to taking the liquor license away from the Buckhorn because that simply will not solve the problem. In my opinion, what will solve the problem is tavern owners and bar tenders who take more responsibility for their actions. In other words, they simply cannot refill a patron glass just because it is empty and they have money laying on the bar."

"I am willing to go with any person who is willing to go with me and speak to every bar owner along 27th St. and exert a little peer pressure on them in a nice way so that they understand the consequences of these senseless deaths".


Sheri Hanneman spoke and said she disagrees with Orville Seymer.
This also happened in her neighborhood.  She is a Mother Against Drunk Driving.
She believes the Buckhorn's license should be revoked.
She said the employees admitted that Eddie Lynn Keck had repeatedly been over served.
The Buckhorn should lose the privilege of having a license.

Mayor Tom Taylor said "Something needs to be done.  If it's Franklin that starts it; then it's Franklin that starts it."

He said he and many from the Council attended the funerals of Mr. and Mrs. Kitchen.  They were good people. 
The Mayor said the family commended our Police and Fire departments.

He said he would consider going with Orville to the bars on 27th Street.

But we have to follow "due process."

That was the theme for the rest of the discussion.


Alderman Sohns said "we must follow due process."
"Hear the facts".
"We are not ready to judge yet."
"We need to be educated."
"We can't rush to judgment; rush to error."
"The bartenders are an important issue."
"It turned his stomach to read the police report."

Alderman Kosovich said "The incident happened in my District."
He wishes we could "shut the bar down tomorrow.  But we can't...we have to follow due process."
Alderman Kosovich made the formal motion to investigate the incident, which was seconded, and approved.

Alderman Solomon said he "was upset when he received the call that night from the Mayor".
"We are the judge and jury on this case."
"We have to follow due process."

Alderman Hammelman said "we are used to things happening quickly."
"But we have to follow due process when you serve as an elected official."
He's on the Licensing Committee and at first he thought it was s "pretty lame committee."
He has "trust in his cohorts."  "Justice will be served."

Alderman Olson first commended the Police and Fire officers saying "Franklin has the finest."
He will use all of his past experience and knowledge regarding the bar industry to
help follow "due process."

Alderman Skowronski said we must "follow due process" with the authority of Council.

Alderman Kosovich spoke again saying "in the future ALL bars are going to be watched more
closely in order to keep something like this from happening again."

There you have it.

Due process...

And what exactly is the "plan of action" to follow "due process"? I hear alot about "due process" but where exactly do we start "due process" and where does it end? And how long will it take?

I read the police report. They did an excellent job of interviewing the involved and documenting their findings. Now exactly how does "due process" proceed from here? And when will we have a finding of fact and action taken?

What they said was we can't "rush to judgement" and we are used to things happening quickly, etc., etc.

I sensed things were positive in nature...

They implied the police reports were perfect.

That's what I got from it.

Sounds like the Mayor and the Common Council all huddled in a room before tonight's meeting and went over the same script, a la the World Wrestling Federation.

This is why I posted what I did tonight at 6:00.

In the interest of justice, I am willing to see this play out.

But justice must prevail.

The statements made to police by the bartenders are damning.

If I had my way, the Common Council would schedule an emergency session and question the Buckhorn owner(s) and, if possible, the bartenders.

If they don't cooperate, that would damage their potential of keeping their license.

If there is doubt, please read the criminal complaint that I linked to in one of my previous blogs.

I conclude with this:

Buckhorn is culpable in the deaths of two innocent people.

If not this incident, Franklin aldermen, then explain to me what the Buckhorn or any other Franklin bar would have to do in order to lose its license?

There was a motion to investigate the incident. What does this mean? Isn't that what the police do? Is there going to be a hearing for the bar owners and bartenders to present their side of the story to the licensing committee? I feel a little uneasy when an Alderman feels he sits on a "pretty lame committee" with a bunch of "cohorts". Some how I don't feel that watching bars more closely in the future is going to do the trick. Innocent people were needlessly killed. A message needs to be sent.

Scott,

Regarding the the "motion."  That's why that isn't in quotes...Kosovich read off the motion, which was lenghty, and didn't explain what it entailed.  I am using teh word investigate.  Perhaps if Steve Olson reads this he can elaborate on that.

Advocating Mom   

As you say, Steve Olson may be able to clarify better, but my take on Ald. Kosovich's motion is that it provides record of the Common Council officially giving notice/permission to the Licensing Committee to immediately begin gathering evidence from every available source so that the "due process" may proceed.

My thanks and appreciation to all who came out on a cold, rainy night to support the safety of our community!!

Ald. Kosovich's motion:  "Motion to direct City staff, including the Police Chief and City Attorney, to investigate allegations in 'State vs. Eddie Lynn Keck,' Milwaukee County Circuit Court Case No. 2007CF006262, pertaining to the Buckhorn Tavern or an operator therein dispensing or serving alcohol beverages to a person who is intoxicated, in cooperation wiht the Milwaukee County District Attorney's Office as may be appropriate, and to undertake such actions or make such recommendations as may be warranted as a result of such investigation."  

Motion passed unanimously.

Let's all keep in mind that the Buckhorn tavern will be facing substantial civil and maybe criminal penalties.

They might just shut down because they will be forced into bankrupcy or they will not be able to obtain insurance to cover this type of incident.

Even if the city is successful in shutting them done, the drunks will only drive down the street to the next bar. In essence, shutting the Buckhorn down will not solve the problem. Peer pressure on the owner and bar tenders might.

The citizens of Franklin and Oak Creek have to make it clear that the past does not equal the future and we will not tolerate this anymore.

Orv,

I agree with you re: the Buckhorn.

But.. I know some of the other establishments on 27th street and I guarantee you they would not put up with the actions described in the police report. They behave responsibly and continuously cut off intoxicated people and then take they're keys and call the person in question a cab. I have seen it happen.

I think the Buckhorn is an example of a business that doesn't care about it's community.

That said, I think the city of Franklin needs to revoke the Buckhorn's liquor license as soon as possible.

The idea is to let all establishments (good & bad)know that we the public are watching them. Again, I think peer pressure can be just as effective as the long arm of the law.
